Like you, privacy is important to us. We do not purchase customer or mailing lists nor do we provide our customer lists to anyone for sale. Please read our privacy policy to learn more about the ways in which we use and protect the personal information that we collect and retain on the site. We want you to fully understand what we do with the information we collect, why we collect it and who we will allow access to it and why we will. Finally, we want to have your consent to continue to collect, use and disclose this information for the purposes outlined in the policy. Overview:

This policy describes the types of information we collect from you as part of our normal operations and what happens to that information. We have tried to make it not boring. We have made it as detailed as possible because we believe you should know as much as possible about what we are doing with the information. The information is who you are and that is important to us. It also allows you to make an informed decision when you decide to use this site for a purchase.

Why we collect personal information:

As our customer, we want to know who you are and where you live. This information is provided by you, normally so that we may ship our books or cards to you. We want your transaction with us to be safe and efficient as well as meet your needs as best as possible. We do not want our customers to be unknown or anonymous to us. If you choose to use our site for a purchase, we will require you to provide us with contact and identity information, billing information, shipping instructions including an alternative address if shipping is to a box number and any other personal information that may be requested from time to time in your use of the site. Understanding your needs allows us to better serve you.

If you are making a purchase using your credit card, we will also require additional financial information. This information is in addition to the name and address information noted above. We may ask for credit card number, security numbers on the rear of the card, expiry dates, the name or names on the card, the billing address and other similar types of information.

We also automatically track certain information about you based upon your behaviour on the site. We use this information to do internal research on our users’ demographics, their interests and click behaviour to better understand and improve our site. This information may include the collection of the URL that you are using to get to us, the URL you go to next from our site, your internal computer configuration including but not limited to the software and browser information and your IP address. We use “cookies” on certain pages of the site. Cookies are small computer files which are placed on your hard drive when you first visit our site. Some of the site features may not be viewed without a cookie being loaded onto your computer. You may be prompted to allow cookies or not, depending on how you have configured your browser on your computer. Cookies may also be used in conjunction with passwords and allow you to use less keystrokes while on the site. Some of the cookies may be session only cookies and will be deleted when you exit the site. When you send us personal correspondence in the form of letters or emails or we have dealings with third parties on your behalf, we may retain this information to provide ongoing customer support. We may also use Web or conversion beacons on the site. These are simple bits of HTML code inserted in the source of a designated website page. This technology works by building on the industry standard browser based cookie technology. It allows for easier, faster and more effective subsequent activity on the site.


When do we disclose information?
 

Generally, we do not disclose your personal information as a matter of policy.  However, there are times we may need to share that information with external third parties who are providing services to us and to you, the customer.  An example would be financial institutions when using your credit card in a transaction.
 
 

We do not provide this information without your explicit consent for us to do so.  We do not control the privacy polices of these third parties and we strongly recommend that you look at and evaluate their policies.

We may make use of the services of web hosting services and external programmers in the design and development of our site from time to time.  These internal service providers are subject to confidentiality agreements with us that prohibit their use of your personal information.

We may disclose a customer’s personal information to a person who, in our reasonable judgement is seeking information as agent for the customer.  We will need to be satisfied that the person requesting the information is the customer’s legal representative and will require that person to provide to us documentation to prove same, such as a legal Power of Attorney from the customer.

We will also cooperate with law enforcement officials.  Upon receipt of a verified request by law enforcement officials or other government officials relating to a criminal investigation or alleged illegal activities, we can disclose your name, city of residence, province, state and/or country of record, telephone number(s), and E-mail address, without a warrant or subpoena.

Due to the existing environment presently in place and legislation in both the United States of America, Canada and some other countries, we cannot ensure that all of your private communications and correspondence will never be disclosed in some way that is not covered in this Privacy Policy.  This may be in the form of intercepted transmissions of data, legislative disclosure, etc.  We can not promise and you should not expect that your personal information will always remain private.

 How do we protect your information? 

In order to protect your privacy, we will not collect information for any purpose other than those identified in this Privacy policy.  We have instituted what we consider to be appropriate security safeguards.  This includes off-site backup to a secure server, timely deletion of information for customers who have not used the site in a set time frame, encryption, firewalls and confidentiality agreements.  It will also include the use of Secure Socket Layer (SSL) protocols.  This protocol allows all personal information such as your credit card information to be encrypted as it moves from your computer to ours.

We will also allow you access to your information to ensure that it is accurate and up-to-date.  Upon your request, we will also deactivate your personal, billing, shipping, financial and contact information from our active database.  Such information will be removed as soon as is reasonably possible.  However, “the perfectly secure web-site” does not exist and please do not expect it on this site.

We will retain some of the information you have requested be removed to prevent fraud, collect monies owing to us, resolve disputes that may arise, assist with any investigations and comply with legal requirements as required by law.  It will however only be available to select personal within the site.

General Notices 

Files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) may not be uploaded, or otherwise made available unless you own or control the rights thereto or have received all necessary consents to do the same. Material or information, including images or photographs, which are on spiritofpowwow.com site may not be used in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.

We may amend the privacy policy from time to time by posting the amended terms on the site.  The changes become effective 30 days after we post them at the top of the policy.  They will be removed from the top of the policy page and incorporated into it at the end of the 30 day period.

Unless you contact us, we will assume that we have your consent to continue to collect your personal information from the site for the purposes previously identified in this policy.

This policy and the practices described in it are subject to the provisions of all applicable legislation and regulations including but not limited to the “Personal Information Protection and Electronic Documents Act” passed in 1998 by the Government of Canada.
